1 – SUBJECT: THIS CONTRACT IS ENTERED INTO BETWEEN BÚSSOLA GRATIFICANTE LTDA. (HEREINAFTER REFERRED TO AS THE LESSOR), THE CUSTOMER AND THE DRIVERS IDENTIFIED THEREIN (HEREINAFTER REFERRED TO AS THE LESSEE). BY THIS CONTRACT THE LESSOR RENTS THE RENTAL COMPANY’S VEHICLE, UNDER THE FOLLOWING GENERAL TERMS AND CONDITIONS, WHICH THE RENTAL COMPANY IS AWARE OF AND AGREES TO:

2 – MINIMUM RENTAL PERIOD: THE MINIMUM RENTAL PERIOD IS 1 DAY (24H). DELAYS OVER 1 HOUR WILL BE CHARGED FOR 1 EXTRA DAY’S RENTAL.

3 – DRIVER: MUST BE OVER 21 YEARS OF AGE, WITH AT LEAST 1 YEAR OF DRIVING PRACTICE; PRESENT A VALID DRIVING LICENSE IN PORTUGAL.

4 – FUEL: VEHICLES MUST BE RETURNED WITH THE SAME FUEL LEVEL AS THEY HAD ON THE DATE OF DELIVERY. IF THE VEHICLE IS NOT RETURNED WITH THE SAME FUEL LEVEL, THE CUSTOMER WILL BE CHARGED FOR THE MISSING AMOUNT IN ACCORDANCE WITH THE MARKETING PRICES PRACTICED ON THE DATE IN QUESTION, PLUS €25 IN ADMINISTRATION COSTS.

5 – VEHICLE RENTAL PRICES: VARIABLE PRICES (FROM AND ACCORDING TO THE TIME OF YEAR)
5.1. – GROUP A – FROM 30€/DAY, GROUP B – FROM €35/DAY, GROUP C – FROM €40/DAY, GROUP D – FROM €45/DAY, GROUP E – FROM 65€/DAY.

6 – INSURANCE AND EXTRAS: 6.1 – THEFT PROTECTION (LDW): INCLUDED. IN THE EVENT OF TOTAL OR PARTIAL THEFT OF THE VEHICLE, THE CUSTOMER IS RESPONSIBLE UP TO THE MINIMUM EXCESS.
6.2 – PERSONAL ACCIDENT INSURANCE (PAI): INCLUDED. COVERS DEATH OR DISABILITY AND MEDICAL EXPENSES FOR DRIVER AND PASSENGERS.
6.3 – AIRPORT SERVICE SUPPLEMENT (APT FEE): DELIVERY AND COLLECTION OF THE VEHICLE AT THE AIRPORT HAS AN ADDITIONAL COST OF €30.00 FOR A TRANSFER FROM 08:00 TO 19:00 AND €40.00 FOR A TRANSFER FROM 19:01 TO 19:01 AT 07:59.
6.4 – DELIVERIES AND COLLECTIONS OUTSIDE OPERATING HOURS: ADDITIONAL COST OF €20.00 PER TRIP.
6.5 – SERVICES AVAILABLE AT ADDITIONAL COST: BABY SEAT €8.00, CHILD BOOSTER €4.00, GPS €5.00 (PRICES PER DAY – SERVICES AVAILABLE ON THE WEBSITE OR AT THE TIME OF BOOKING).
6.6 – ADDITIONAL DRIVER: DAILY COST OF €8
6.7- DELIVERY FEE OUTSIDE THE CITY OF FUNCHAL:  ADDITIONAL COST OF €25.00 PER TRIP.

7 – PRICES INCLUDE: SUPER EXCESS EXEMPTION (SCDW), PERSONAL ACCIDENT INSURANCE (PAI), VAT, LIMITED LIABILITY INSURANCE, MAINTENANCE AND 24-HOUR TRAVEL ASSISTANCE.

8 – PRICES DO NOT INCLUDE: AIRPORT TRANSFER, PARKING EXPENSES, FINES, FUEL AND LOSS OF DOCUMENTS, IN THIS CASE THE CUSTOMER WILL BE CHARGED THE AMOUNT OF €150.00 FOR ISSUING THE SAME, THE CUSTOMER WILL ALWAYS BE RESPONSIBLE FOR ALL DAMAGES CAUSED TO THIRD PARTIES OR TO THE RENTED VEHICLE WHENEVER IT:
8.1 – BE DRIVEN BY A PERSON WHO IS NOT LEGALLY QUALIFIED OR AUTHORIZED TO DO SO BY BÚSSOLA GRATIFICANTE, LTDA.
8.2 – SUFFER DAMAGES INTENTIONALLY CAUSED BY THE CUSTOMER OR A PERSON FOR WHOM THEY ARE RESPONSIBLE.
8.3 – BE DRIVEN BY A PERSON UNDER THE INFLUENCE OF ALCOHOL, DRUGS OR SUFFERING FROM MENTAL INSANITY.
8.4 – BE USED IN SPORTING EVENTS, RALLY, CHALLENGES, COMPETITIONS, ETC.
8.5 – SUFFER AN ACCIDENT AND IT IS NOT REPORTED TO BÚSSOLA GRATIFICANTE LTDA. AS SOON AS REASONABLY POSSIBLE UNDER THE CIRCUMSTANCES.
8.6 – SUFFER ACTS OF VANDALISM, SUCH AS BROKEN GLASS, BURST TIRES OR DAMAGED WHEELS.
8.7 – BURST OF TIRE AND UNDER PART OF THE VEHICLE (EX: BOTTOM OF THE ENGINE).
8.8 – NEGLIGENT DRIVING AND DAMAGES CAUSED BY IT.
8.9 – THE CUSTOMER IS RESPONSIBLE FOR ALL ROAD INFRACTIONS COMMITTED.

9 – IN CASE OF ACCIDENT:  THE LESSEE MUST, AS SOON AS REASONABLY POSSIBLE UNDER THE CIRCUMSTANCES, CALL THE LOCAL POLICE AUTHORITIES (112) AND NOTIFY BÚSSOLA GRATIFICANTE, LTDA. THROUGH THE ASSISTANCE SERVICE.

11 – DATA PROTECTION: THE LESSEE AUTHORIZES THE INTRODUCTION OF HIS/HER PERSONAL DATA INTO THE RENTAL COMPANY’S FILE FOR PROCESSING WITHIN THE PURPOSE OF THIS FORM AND, SPECIFICALLY, FOR MARKETING PURPOSES, CUSTOMER SATISFACTION SURVEYS AND TO PROVIDE INFORMATION ABOUT PRODUCTS AND SERVICES, IN COMPLIANCE WITH THE GENERAL DATA PROTECTION REGULATION (LAW NO. 58/2019, OF AUGUST 8). THE LESSEE MAY EXERCISE THE RIGHTS OVER HIS/HER DATA PROVIDED FOR BY LAW BY REGISTERED LETTER SENT TO BÚSSOLA GRATIFICANTE, LDA., TO THE ADDRESS RUA DA PONTA DA CRUZ, C. C. 12 – EXERCISE OF RIGHTS: THIS ESTABLISHMENT HAS A PHYSICAL AND ELECTRONIC COMPLAINTS BOOK (WWW.LIVRODERECLAMACOES.PT) AS PROVIDED FOR BY DECREE-LAW NO. 156/2005, OF SEPTEMBER 15, AMENDED BY DECREE-LAW NO. 74/2017, OF 21 JUNE.
